The collective action for water in colombia and the referendum as direct democracy approach

Abstract

The analysis of collective action in defense of water takes up the history of mobilization in the country from 1909 to 2009, the management of community aqueducts, and consolidated the use of legal tools, up to the referendum on the water as significant moment of mobilization, identifying how causes change with privatization, legislation and marketing of commons and services of natural resources, carrying to a time of political commitment and a participatory and direct democracy, to the consecration of water as a human right, through a referendum of a citizens' initiative, placing the issue on the public agenda with access to a basic minimum of water as a mechanism to achieve the right to water, the strengthening of community aqueducts and discussion about the legislative process of the referendum.

El análisis de la acción colectiva en defensa del agua retoma el historial de movilización en el país desde 1909 a 2009; la gestión de acueductos comunitarios; y un consolidado del uso de herramientas jurídicas, hasta llegar al referendo por el agua como momento significativo de movilización, identificando cómo las causas cambian ante la privatización, marcos legislativos y la comercialización de bienes y servicios de recursos naturales, conllevando a un momento de apuesta política y de democracia participativa y directa, hacia la consagración del agua como derecho humano, a través de un referendo de iniciativa ciudadana, el cual posicionó el tema en la agenda pública con el acceso a un mínimo vital de agua como mecanismo de efectividad del derecho al agua, el fortalecimiento de acueductos comunitarios y la discusión sobre el proceso legislativo del referendo.
