Análisis de la reforma institucional de la política pública de regalías en Colombia

Abstract

Este documento titulado “A nálisis de la reforma institucional de la política pública de regalías en Colombia” , presenta los motivos, la estructura y los argumentos que dieron lugar a la modificación del anterior régimen de regalías y hacer transito al actual Sistema General de Regalías del cual se presenta la descripción sus características, la evolución, el diseño, las limitaciones y las fallas del anterior régimen; finalmente de exponen los principios que sustentan el modelos institucional propuesto para el actual sistema. Este análisis, parte de los desarrollos normativos del régimen de regalías; el estudio de los argumentos que suscitaron la presentación del acto legislativo 005 de 2011 , la sostenibilidad fiscal de la nación, la nueva regla fiscal, la constitución de actores, la exposición de sus posturas y el resultado en referencia a la nueva estructura e institucionalidad para la administración, distribución, usos y control de los recursos de regalías. This analysis of the regulatory developments of royalty regime; the study of the arguments raised the presentation of the legislative act 005 of 2011, fiscal sustainability of the nation, the new fiscal rule, discussions around dit were generated from different areas and with the participation of different actors, which led to a new organization and institutions for the administration, distribution, use and control of resources royalties.
