dc.description.abstractPartiendo de la autorización del titular del dato como parte del núcleo central actual del derecho fundamental al Habeas Data en el ordenamiento colombiano y frente al análisis comparado, el trabajo determinará si acorde con los retos que imponen los avances tecnológicos y, especialmente, el manejo de grandes volúmenes de información, es posible reconciliar los modelos aparentemente antagónicos de protección de datos (Europeo y Norteamericano) y concretar la aspiración de una ley de alcance universal sobre la materia.
dc.description.abstractAbstract: The aim of this work tries to determine if the if the legal requirement of the authorization of the information’s holder for his later managing, use, treatment and spreading, as expression of the fundamental right to Habeas Data in the Colombian legal system, is one of the factors that has prevented the implementation of a global data protection regime, reconciling in this way both traditional models: the European and the North American, in an environment that seems to need it, because of the management of big volumes of information, in an included and widely systematized world, has led to blurring the borders in this matter. The first chapter (state of the art) presents the evolution of the concept of authorization and how it operates in the Colombian legal system, departing from the jurisprudence of the Constitutional Court, the only referent for about 17 years and which sat the courses of the subsequent legislation and regulation regarding Habeas Data, determining the corresponding jurisprudential line. In the same way, the jurisprudential developments subsequent to the laws of 2008 and 2012 and the practical result of the exercise of the sanctioning faculty of the Superintendence of Industry and Commerce - entity in charge of the surveillance and control in the matter of data protection; that together specify the obligations of respect and guarantee of the right, by the Colombian State. The second chapter (theoretical frame) presents the references to the data holder’s authorization in the binding agreements (part of the legal Colombian classification for the route of the block of constitutionality) as in the instruments from multilateral organisms (sometimes it indexes of better practical and others, imperatives for compliance with standards), as well as in the European and North American privacy and data protection models, and its most recent developments (General Regulation of Protection of Information for the European Union, in force since the 25th May 2018 and the California Consumer Privacy Act of 2018). Basing on the authorization of the holder of the data as part of the current central core of the fundamental right to the Habeas Data in the Colombian system and, opposite to the compared analysis, the work will determine if according to the challenges imposed by technological advances and the handling of big volumes of information, it is possible to reconcile both antagonistic models and to make concrete the aspiration of a law of universal scope on this matter.
