dc.description.abstractA lo largo de las siguientes páginas, el lector podrá enterarse de las acciones del Banco Mundial (BM) dirigidas a consolidar una economía neoliberal de mercado a escala global, mediante la modificación de las instituciones judiciales de países en desarrollo en Latinoamérica y, en últimas, mediante la modificación de la noción de Estado de derecho, que cada país, en tanto entidad soberana, debiera establecer independientemente. La expresión "globalización del derecho" se constituye en un elemento especialmente relevante para el trabajo, porque sintetiza en qué marco y con qué pretensión actuó el BM. Se comienza con un recorrido histórico de los intentos por parte del Banco Mundial de construir una agenda de gobernanza frente a los países destino; el segundo capítulo se centra en describir de qué manera el BM entendió el concepto de Estado de derecho -garantía de derechos humanos, seguridad jurídica de actores económicos-, no lo aplicó en acciones concretas y, en cambio, lo dejó en lineamientos generales; a continuación, se realiza una valoración crítica del argumento de "intervención" del BM, según el cual el Estado de derecho juega un papel fundamental en el desarrollo de los países, y se examina cómo han influido los marcos jurídicos de países asiáticos en su crecimiento económico; finalmente, se discute el caso específico de Bolivia, país donde el BM cifró sus expectativas de colaboración a través de reformas judiciales y proyectos con un marcado acento tecnocrático, y se comprueba que estas intervenciones resultan nocivas en términos de la autonomía legislativa y el desarrollo económico de los países latinoamericanos.
