La discusión se centra en la tensión entre el derecho a la libertad de expresión y la prohibición de la discriminación. De un lado, si se permite controlar el discurso, se intervendría entonces el contenido de las expresiones y es materia de controversia los efectos de tal intervención. De otro lado, si no se efectúa ningún control a los discursos discriminatorios, se permite la reproducción de un acto que puede ser violento y atentatorio de los derechos de grupos de especial protección, que en muchas ocasiones, ha sido el primer paso para crear un mecanismo de violencia mucho más fuerte. El siguiente trabajo busca aproximarse al debate descrito, desde una comparación de los discursos de odio en Estados Unidos y en Europa. Posteriormente intenta exponer algunas conclusiones preliminares sobre este tema en Colombia. The discussion focuses in the tension between the freedom of speech and the principle of equality and non-discrimination. In one hand, if it is allowed to control the speech, it would imply as well the existence of interference related whit the content of the expression, and the effects of such decision are a matter of controversy among the experts. In the other hand, if it’s considered that is not allowed to control the discriminatory-speech, it would be therefore allowed to proffer a violent act, which affects especially the rights of special protection groups and can be the basis of a further and harder act of violence.
