Esta situación se ha visto reflejada en las múltiples quejas, tutelas y derechos de petición de los internos, así como en las sentencias proferidas por la Corte Constitucional Colombiana, donde en múltiples ocasiones se ha declarado el estado de cosas inconstitucionales que incluyen la violación del derecho a la dignidad humana, el derecho a la salud, el derecho a la resocialización, y el derecho a la alimentación adecuada, entre otros. Derivado de lo anterior, nace este trabajo de investigación, cuyo objetivo ha sido analizar el papel que juega la oferta institucional del Estado colombiano en el cumplimiento de las obligaciones de garantía, respeto y protección del derecho a la alimentación de la población privada de la libertad a cargo del Instituto Nacional Penitenciario y Carcelario – Inpec; entendiendo este derecho como un todo, como aquel que se interrelaciona, se interconecta y se complementa con derechos fundamentales que favorecen la resocialización de las personas privadas de la libertad, permitiéndoles alcanzar un nivel de vida digno que contribuya en su libre desarrollo.For years, the population deprived of liberty has suffered the scourge of discrimination and social marginalization, due to the crimes committed, where they not only have to pay long sentences of deprivation of their liberty, but also bear the stigma social that this entails, where the same state institutions have failed in their role of guaranteeing the rights of this population group. This situation has been reflected in the multiple complaints, guardianships and rights of petition of the inmates, as well as in the sentences handed down by the Colombian Constitutional Court, where on multiple occasions the unconstitutional state of affairs has been declared that includes the violation of the right to human dignity, the right to health, the right to re-socialization, and the right to adequate food, among others. This difficult situation has led the Colombian State, through its Governments and institutions, to seek alternative solutions that allow mitigating the current prison crisis, but contrary to this, the gap has become larger and larger, due to the strong corruption problems that surround these institutions, the lack of political will and the lack of implementation of effective public policies that allow there to be a constant and progressive guarantee of the human rights of the PPL, especially of its right to freedom. adequate food.
