Así, a través del análisis de la normativa y jurisprudencia nacional, en perspectiva comparada con las decisiones de la Corte Interamericana de Derechos Humanos, se pretende dar cuenta de la evolución metamórfica de la responsabilidad del Estado que, a través de la reparación integral, especialmente de derechos constitucional y convencionalmente amparados, supera nociones netamente patrimoniales. (Texto tomado de la fuente).In Colombia’s legal system, the State’s patrimonial responsibility has undergone massive changes in terms of reparation processes, from which it is possible to infer that this institution has experienced a metamorphosis. This transformation has been possible because of the right and principle of integral reparation, which incorporates different non-pecuniary measures to make reparation for nonlegal damage caused by State acts or omissions. Consequently, some issues need to be discussed in this context, such as the implementation of different types of justice within transitional circumstances, the active role of judges in a social State under the rule of law, and the consideration of other constitutional principles. Therefore, by analyzing national jurisprudence and regulations, and from a comparative approach considering decisions made by the Inter-American Court of Human Rights, this paper aims to account for the metamorphic evolution of the State's responsibility.
