Se trata de un estudio de Jurídico-Proyectivo o de Pronóstico, en el que se intenta resolver la pregunta: ¿cómo es o cómo va a ser?, o ¿en qué momento se va a dar realmente este reconocimiento?, de conformidad con las resoluciones que están tomando los jueces, las cuáles deben permitir descubrir el verdadero sentido de la ley, de conformidad con los principios y criterios contenidos en el ordenamiento jurídico. En este sentido, y de conformidad con lo ya expresado por el Tribunal de Justicia Especial para la Paz, se está trabajando en la construcción de espacios dialógicos que permiten la toma de decisiones a través de un proceso deliberativo, es decir, que la verdad se va construyendo en diversas etapas con participación de todos los actores hasta llegar a una expresión plena de la misma sobre la cual se pueda proceder a la reparación y alcanzar la finalidad de justicia y no repetición que contiene la ley.
