El derecho como discurso en la jurisprudencia de la corte constitucional colombiana

Abstract

El trabajo busca evidenciar la existencia de discursos políticos subyacentes en decisiones tomadas por la corte constitucional colombiana durante los años 90, proponiendo que en materia de derechos fundamentales y fundamentación teórica del Estado social de derecho, ese cuerpo judicial fue especialmente progresista, pero tratándose de derechos sociales y la estructura económica del Estado, la Corte se mostró conservadora. Para caracterizar esta faceta discursiva del derecho, en su primera parte el escrito reconstruye los antecedentes de irrupción del denominado giro lingüístico de la filosofía en el derecho, lo que sirve para determinar la naturaleza propia del discurso jurídico. En la segunda parte, tras efectuar el análisis específico de sentencias de la Corte sobre los temas mencionados atrás, el trabajo propone que con la Constitución de 1991 y al abrigo de novedosas corrientes de teoría jurídica se generó en Colombia un nuevo derecho, que en su interior alberga una tensión originada en la lucha política por su significado.

The work tries to demonstrate the existence of underlying political discourses in decisions made by the Colombian Constitutional Court during the ’90s. It proposes that in matter of fundamental rights and theoretical exposition of social state of law,that Court was specially progressive, but treating social rights and economic structure of the State, the Court was conservative. In order to characterize this discursive facet of the Law,in its first part the writing reconstructs the antecedents of irruption of denominated “linguistic turn of philosophy” in the Law, which serves to determine the own nature of the legal discourse.In the second part, after realize the specific analysis of sentences of the Court on the mentioned subjects, the work proposes that since the Constitution 1991 and because the influence of new schools of legal theory there was generated a new law in Colombia, which in its interior lodges a tension originated in the political fight by its meaning.
