Hemos planteado la pregunta de si la responsabilidad del banco en eventos de phishing en operaciones pasivas corresponde a una responsabilidad objetiva, teniendo en cuenta que la jurisprudencia lo ha dicho así en relación con los reembolsos a través de cheques. Durante la investigación, teniendo en cuenta la naturaleza del dinero y la estructura obligacional de la operación de depósito, encontramos que la obligación del banco no es de custodia, sino de restitución, y que ésta configura un pago de obligación de dinero a favor del usuario;; de esta suerte, encontramos que el centro del asunto no está en el régimen de responsabilidad, sino en el régimen general de obligaciones. Ya en este punto, encontramos que el pago realizado al tercero malintencionado no logra la extinción de la obligación que el banco tiene frente al usuario acreedor, ya que aquélla es, funcionalmente, de género;; esto, sin perjuicio de que, eventualmente, el banco pueda argüir la culpa del usuario para exonerarse o morigerar su responsabilidad, debiendo demostrar que el usuario incurrió en culpa grave. We have set out a question about bank liability in phishing cases performed on deposit accounts, asking if the law has imposed strict liability on the bank in such events, given that case-law have said so about check withdrawals. During our research, we took into account money’s nature and the structure of the obligations derived from the contract between the bank and the consumer, which led us to acknowledge that the obligation of the bank is not to watch over the deposit, but to refund it, which means that the bank has towards the user an obligation to pay money. In this point, we found out that when the malicious third-part is paid by the bank, this one does not extinguish its obligation towards the creditor consumer, since that obligation is functionally, a generic real obligation;; nonewithstanding, the bank is allowed to put forward the consumer’s fault, in order to extinguish, totally or parcially, its obligation, having to demonstrate lata negligentia in the consumer’s behaviour.Palabras clave
