Economías colaborativas y la libertad de competencia en Colombia: el caso Airbnb

Abstract

En el presente trabajo se abordará la condición de la regulación económica, la intervención del estado en la economía y la regulación del Turismo, el contexto de una actividad de importancia económica, para luego adentrarnos en el estudio de la tecnología en el turismo AIRBNB, y así establecer los criterios de operación y de legalidad del servicio y el derecho de la competencia que sobre dichas condiciones se genera, igualmente abordando un esquema de análisis económico de la reglamentación contraponiendo diferentes tesis sobre el particular. También se establecen las posiciones a la problemática, en donde se plantean las discusiones desde el punto de vista del teorema de COASE, el análisis económico del derecho y los choques entre la intervención estatal en la economía y el libre mercado, abordando las decisiones de Tribunales extranjeros la misma problemática y presentando las distintas iniciativas que en Colombia se han intentado, no sobre el problema en sí, si no sobre materias similares, o aspectos muy puntuales sobre este tipo de “economías”. This paper will address the condition of economic regulation, state intervention in the economy and regulation of Tourism, the context of an activity of economic importance, and then delve into the study of technology in tourism AIRBNB, and thus, to establish the criteria of operation and legality of the service and the competition law that is generated on said conditions, also addressing a scheme of economic analysis of the regulation contrasting different theses on the matter. The positions of the problem are also established, where the discussions are raised from the point of view of the COASE theorem, the economic analysis of the law and the clashes between state intervention in the economy and the free market, addressing the decisions of Courts foreigners the same problem and presenting the different initiatives that have been tried in Colombia, not on the problem itself, but on similar matters, or very specific aspects of this type of “economy”.
