Voces, caminos y meandros de la excepcionalidad: una historia mundial comparada con énfasis en Colombia, la vertiente del Estado de Sitio a la Excepción Permanente (1948-2020)

Desde una mirada universal e histórica, esta investigación pretendió reconstruir las facultades de excepción, a partir de los inicios del constitucionalismo que se estructura a finales del siglo XVIII. Las mismas (estado de sitio, martial law, emergency Powers) han sido una opción latente y extendida; antes que delimitarse, se han expandido y han logrado adquirir nuevos espacios, nuevas dimensiones y formas de presentación, instalándose como una técnica permanente. Logran siempre, de manera sutil, escapar del cauce constitucional, de la jaula con la que se pretende mostrar que se ha domesticado la fiera; a la manera de MEDUSA, su mirada continúa petrificando el ordenamiento, tal y como se concebía en la lejana estructura de l’état de siége. A través de lo ocurrido en 2020, la expansión de la enfermedad de la COVID-19, se pudo establecer con claridad esa nueva faceta de la excepción, pero no exclusivamente en ese momento. La mezcla de atribuciones policivas y sanitarias condujo a la más importante restricción de derechos y garantías que se haya tenido noticia en la historia de la humanidad, sin que en muchos casos se haya realizado una declaratoria formal de anormalidad; ha imperado la indeterminación y la mixtura. No obstante, ello cuenta con una historia más profunda y unos cauces que este trabajo pretendió recomponer. Tanto en el escenario nacional como en sus dimensiones internacionales proliferan ejemplos de excepciones de facto o de regímenes impuestos que conducen a profundas limitaciones, tal y como ha ocurrido con las unilaterales sanciones económicas o con la lógica de la guerra imperial, sin dejar de lado otros mecanismos de sujeción a un régimen marcial internacional. Para el caso colombiano, a pesar del nuevo ordenamiento expedido en 1991, la salida del tenebroso estado de sitio y de la captura administrativa y la profundización del control de la Corte Constitucional, se han activado otros mecanismos de excepción, algunos de ellos legado de la anterior lógica que se cimentó desde 1948, la cual se reconstruye con detalle en este trabajo, otros adaptados a los nuevos tiempos, como el régimen marcial fiscal o el sobredimensionamiento de las facultades de policía. En ese proceso, adquiere especial significación el paulatino tránsito del mencionado estado de sitio a la emergencia, un proceso que ha vivido el estado francés al refugiarse en el estado de urgencia. Esta revisión permite revalorar el sistema político colombiano que se ha presentado como una de las “democracias” más estables y antiguas del continente. El presente enfoque exigió recomponer el concepto de excepción y trascender, así, su limitado alcance dogmático, sin perjuicio de dirigir el análisis con base en su entendimiento constitucional. La aproximación teórica y metodológica ha permitido redescubrir la figura, su uso, su crecimiento y sus mecanismos alternos. El trabajo, además, contiene una importante y prolija compilación de los estados de excepción declarados en Colombia y sus desarrollos a partir de 1949 y hasta 2020, entre otros documentos de apoyo. From a universal and historical perspective, this research aimed to reconstruct the powers of exception, starting from the beginnings of constitutionalism, which was structured at the end of the 18th century. These powers (state of siege, martial law, emergency powers) have been a latent and widespread option; rather than being delimited, they have expanded and have managed to acquire new spaces, new dimensions and forms of presentation, establishing themselves as a permanent technique. They always manage, in a subtle way, to escape from the constitutional channel, from the cage with which they pretend to show that the beast has been tamed; in the manner of MEDUSA, their gaze continues to petrify the order, as it was conceived in the distant structure of l'état de siége. Through what happened in 2020, the spread of the COVID-19 disease, this new facet of the exception could be clearly established, but not exclusively at that time. The mixture of police and health powers led to the most important restriction of rights and guarantees in the history of humanity, without a formal declaration of abnormality in many cases; indeterminacy and mixture have prevailed. Nonetheless, this has a deeper history and channels that this work aims to reconstruct. Both on the domestic scene and in its international dimensions, examples of de facto exceptions or imposed regimes that lead to profound limitations proliferate, such as unilateral economic sanctions or the logic of imperial war, not to mention other mechanisms of subjection to an international martial regime. In the Colombian case, despite the new legislation issued in 1991, the end of the dark state of siege and administrative capture, and the deepening of the Constitutional Court's control, other mechanisms of exception have been activated, some of them a legacy of the previous logic that was cemented since 1948, which is reconstructed in detail in this work, others adapted to the new times, such as the fiscal martial regime or the over-dimensioning of police powers. In this process, the gradual transition from the aforementioned state of siege to emergency, a process that the French state has undergone by taking refuge in the state of emergency, acquires special significance. This review allows us to reassess the Colombian political system, which has been presented as one of the continent's oldest and most stable "democracies". The present approach required the concept of exception to be reconstructed and thus transcend its limited dogmatic scope, without prejudice to directing the analysis on the basis of its constitutional understanding. The theoretical and methodological approach has made it possible to rediscover the concept, its use, its growth and its alternative mechanisms. The work also contains an important and detailed compilation of the states of exception declared in Colombia and their developments from 1949 to 2020, among other supporting documents.Palabras clave
