Justicia comunitaria campesina. Estudio de caso hacia un reconocimiento constitucional

Este trabajo, enmarcado en la línea de la sociología del derecho, pretende demostrar la existencia de una justicia comunitaria, propia de las comunidades campesinas de la región de Guamocó, ubicada en la estribación suroeste de la Serranía de San Lucas, en la intersección de los municipios de El Bagre y Nechí, departamento de Antioquia, y Santa Rosa del Sur y Montecristo, departamento de Bolívar; corolario de su posición periférica respecto a los centros de distribución de los recursos económicos, sociales y culturales por un lado, y el conflicto armado del que ha sido escenario histórico, por otro. Para hacer esa demostración, primero, se describe la configuración histórica del sujeto en clave de la presencia estatal limitada a los ámbitos extractivista y militar; segundo, identificando los sistemas jurídicos que surgen como resultado de esa imposibilidad material que tienen las comunidades de acceder a la justicia del Estado; y tercero, analizando el origen de la justicia campesina, y describiendo sus mecanismos de intervención en los conflictos comunitarios. El enfoque utilizado fue de Investigación Acción Participativa, y fue implementado en el marco de la labor de asesor jurídico y en Derechos Humanos que el investigador ejerce al interior de la Asociación de Hermandades Agroecológicas y Mineras de Guamocó -AHERAMIGUA-, organización de base campesina conformada en el año 2007 con el fin de enfrentar la crisis humanitaria que viven los habitantes de la región a causa del conflicto armado, y garantizar su permanencia en el territorio evitando la extracción masiva de los recursos naturales. This work, framed in the line of sociology of law, aims to demonstrate the existence of a community justice, typical of the Guamocó region peasant communities, located in the southwestern foothills of the Serranía de San Lucas, at the intersection of the municipalities of El Bagre and Nechí, Antioquia Department, and Santa Rosa del Sur and Montecristo, Bolívar Department; corollary of its peripheral position in relation to the economic, social and cultural resources distribution centers on one hand, and the armed conflict of which it has been the historical scenario, on the other. To make this demonstration, first, the historical configuration of the subject is described in terms of government presence limited to the extractivist and military spheres; second, identifying the legal systems that arise because of this material impossibility the communities have to access State justice; and third, analyzing the origin of peasant justice, and describing its intervention mechanisms in community conflicts. The approach used was Participatory Action Research, and it was implemented in the development of the job as legal and Human Rights adviser that the researcher performs within the Association of Agroecological and Mining Brotherhoods of Guamocó -AHERAMIGUA-, a peasant-based organization formed in 2007 in order to face the humanitarian crisis that the inhabitants of the region are experiencing due to the armed conflict, and guarantee their permanence in the territory avoiding the massive extraction of natural resources.Palabras clave
