El ejercicio del control fiscal preventivo y concomitante frente a la prohibición de coadministración en la gestión pública

El presente trabajo de investigación busca abordar las principales características del ejercicio del control fiscal a partir de la Constitución de 1991, en tanto control posterior y selectivo, actualmente vigente; entre ellas, la denominada función de advertencia, prevista en la redacción original del artículo 5 numeral 7 del Decreto Ley 267 de 2000, que facultaba a la Contraloría General de la República para «Advertir sobre operaciones o procesos en ejecución para prever graves riesgos que comprometan el patrimonio público y ejercer el control posterior sobre los hechos así identificados» pero que, al ser demanda fue declarada inexequible por la Corte Contitucional. Posteriormente, plantearemos un estudio crítico sobre las nuevas categorías del control fiscal preventivo y concomitante que se ejerce a través de la nueva función de advertencia, pero ahora prevista a través del Acto Legislativo 004 de 2019. La función de advertencia y el nuevo sistema de control fiscal preventivo y concomitante, imponen una revisión de dichas categorías ahora de rango constitucional, y su compatibilidad con el control fiscal posterior y selectivo consagrado en la misma disposición constitucional, al igual que nos permite revisar desde un punto de vista constitucional, si el acto legislativo era necesario para mejorar la gestión preventiva de la Contraloría General de la República frente a la vigilancia de la gestión fiscal de las entidades del Estado. This research work seeks to address the main characteristics of the exercise of fiscal control from the Constitution of 1991, as a subsequent and selective control, currently in force; among them, the so-called warning function, provided for in the original wording of article 5 numeral 7 of Decree Law 267 of 2000, which empowered the Comptroller General of the Republic to «Warn about operations or processes in execution to anticipate serious risks that compromise public property and exercise subsequent control over the events thus identified» but which, being a lawsuit, was declared unenforceable by the Constitutional Court. Subsequently, we will propose a critical study on the new categories of preventive and concomitant fiscal control that is exercised through the new warning function, but now provided for through Legislative Act 004 of 2019. The warning function and the new system of preventive and concomitant fiscal control, impose a review of said categories now of constitutional rank, and its compatibility with the subsequent and selective fiscal control enshrined in the same constitutional provision, as well as, allows us to review From a constitutional point of view, if the legislative act was necessary to improve the preventive management of the Comptroller General of the Republic against the surveillance of the fiscal management of State entities.Palabras clave
