Teoría decolonial y constitucionalismo (andino): límites teóricos y nuevos horizontes

Abstract

La presente tesis de maestría tiene como objetivo fundamental explorar, a partir de los análisis de las recientes experiencias constitucionales de Ecuador (2008) y Bolivia (2009), los puntos de contacto y los límites teóricos que surgen del dialogo entre la teoría decolonial y los estudios constitucionales. En ese sentido se reconstruye, en un primer momento, las diversas y diferentes lecturas que han surgido en torno al nuevo constitucionalismo latinoamericano. En segundo lugar, se marca un énfasis en la lectura decolonial, identificándose los principales los límites teóricos de este enfoque. Finalmente, en un tercer momento, se proponen, desde la idea de analítica decolonial del constitucionalismo, algunas alternativas para la superación de dichas limitaciones. The present thesis of mastery has as fundamental aim(lens) explore, from the analyses of the recent constitutional experiences of Ecuador (2008) and Bolivia (2009), the points of contact and the theoretical limits that arise from the dialog between(among) the decolonial theory and the constitutional studies. In this sense there are reconstructed, in the first moment, the diverse and different readings that have arisen concerning(around) the new Latin-American constitutionalism. Secondly, an emphasis is marked in the reading decolonial, the principal ones being identified the theoretical limits of this approach. Finally, in the third moment, they propose, from the idea of analytical decolonial of the constitutionalism, some alternatives for the overcoming of the above mentioned limitations.
