La preferencia del Contrato de Renting frente al Contrato de Leasing en Colombia

Abstract

Este trabajo tiene como propósito examinar la evolución del contrato de Leasing y el contrato de Renting mostrando los aspectos más relevantes de estas figuras contractuales; partiendo de la atipicidad de estos contratos, se analizan sus similitudes y diferencias encontrando que el segundo tiene algunas características que lo hacen económica y jurídicamente más atractivo para los usuarios de servicios de arrendamiento mercantil, generando un incremento en su utilización y desarrollo en Colombia, evidenciándose actualmente que en servicios donde prevalecía el Leasing ahora se utiliza el contrato de Renting. The purpose of this research is to examine the evolution of Leasing and Renting contracts, presenting the most relevant aspects of these contractual figures. The starting point was from their outlier characteristics. After, their similarities and differences were analyzed. As a result, it was discovered that the second one has some features that it makes economically and juridically more attractive for the users of trade leasing services, which generates in turn an increase in its development and deployment in Colombia; moreover, it reveals that the services where Leasing prevailed, now Renting has taken its place.
