dc.description.abstractLa presente investigación pretende determinar si las actuales teorías de cumplimiento del Derecho Internacional, que incorporan los conceptos de las Relaciones Internacionales y otros campos, permiten resolver de manera satisfactoria el problema del cumplimiento en el marco del caso de Jurisdicción de Pesquerías entre Islandia, Gran Bretaña y Alemania Occidental. En el primer capítulo de este trabajo académico, correspondiente al estado del arte, se hace una revisión de la evolución teórica reciente sobre el cumplimiento en el Derecho Internacional, desde 1960 hasta el surgimiento de la llamada “Agenda Dual” a principios de 1990. Para este fin, se divide la reconstrucción en cinco grandes momentos argumentativos. En el segundo capítulo se reconstruye analíticamente las teorías más importantes sobre cumplimiento del Derecho Internacional, que se sitúan en el ámbito de trabajo de la Agenda Dual, desde los enfoques realista, institucionalista, procesalista, gerencial, normativista y liberal. Esta reconstrucción presenta el debate teórico entre las distintas teorías con el fin de tener un panorama completo que permitirá emprender un análisis casuístico en el capítulo tercero. En el capítulo final se aborda el problema de investigación basado en la información expuesta en el capítulo segundo, concretamente en el caso de la “Jurisdicción de Pesquerías” entre tres naciones democráticas y civilizadas: Islandia, Gran Bretaña y Alemania Occidental. Este caso, conocido como las “guerras del bacalao”, es particularmente relevante para poner a prueba las teorías de cumplimiento. En este contexto, se verifica si a la luz de las teorías de cumplimiento, el difícil caso de la “Jurisdicción de Pesquerías” es consistente con los planteamientos teóricos reconstruidos. dc.description.abstractThis research aims to determine if the current theories of compliance with International Law, which incorporate the concepts of International Relations and other fields, allow a satisfactory resolution of the problem of compliance in the framework of the Fisheries Jurisdiction case between Iceland, Great Britain. and West Germany. In the first chapter of this academic work, corresponding to the state of the art, a review of the recent theoretical evolution on compliance in International Law is made, from 1960 to the emergence of the so- called "Dual Agenda" in the early 1990s. For this aim, the reconstruction is divided into five major argumentative moments. In the second chapter, the most important theories on compliance with International Law are analytically reconstructed, which are located in the scope of work of the Dual Agenda, from the realistic, institutional, procedural, managerial, normative and liberal approaches. This reconstruction presents the theoretical debate between the different theories in order to have a complete panorama that will allow us to undertake a casuistic analysis in the third chapter. The final chapter addresses the research problem based on the information presented in the second chapter, specifically in the case of the "Fisheries Jurisdiction" between three democratic and civilized nations: Iceland, Great Britain and West Germany. This case, known as the “cod wars”, is particularly relevant to testing compliance theories. In this context, it is verified whether, in the light of compliance theories, the difficult case of the "Fisheries Jurisdiction" is consistent with the reconstructed theoretical approaches.eng
