Aportes del sistema interamericano de derechos humanos en la reparación integral de víctimas: análisis del caso colombiano

Abstract

En el marco del SIDH, la Corte IDH ha fijado parámetros evolutivos sobre reparación integral a víctimas. Recientemente, el Estado colombiano ha adoptado varias decisiones, en reconocimiento del derecho a la reparación integral de las víctimas de violaciones a los derechos humanos e infracciones al DIH, producto del conflicto armado y la violencia presentes en el país. Teniendo en cuenta ambas circunstancias, se plantea la cuestión sobre la influencia ejercida por la Corte IDH en materia de reparaciones, en los mecanismos internos de reparación que ha adoptado Colombia. Esta investigación plantea que el grado de influencia ha sido muy alto; y, a su vez, anticipa debates futuros en el litigio ante el SIDH, pues la cualificación de los mecanismos internos, planteará a las victimas la pregunta sobre el mecanismo a acceder para buscar la reparación de la violación de sus derechos. Under the Inter-American System of Human Rights, the Inter-American Court of Human Rights has set evolutionary parameters on integral reparation to victims. Recently, the Colombian State has taken several decisions, recognizing the right to the reparation of victims of Human Rights violations and breaches of International Humanitarian Law, produced under the context of an armed conflict and the violence in the country. Taking into account these two facts, it is raised the question of the influence of the Inter-American Court of Human Rights on victim's reparations, in the internal mechanisms adopted by Colombia. This research suggests that the degree of influence has been very high; and, in turn, it anticipates future debates on the litigation before the Inter-American Human Rights System. Thus, the qualification of internal mechanisms, will pose a question to the victims about the mechanism to seek reparation for violation of their rights.
