Resumen: La presente investigación doctoral indaga sobre la construcción histórica de la concepción de crimen pasional, en un estudio sobre Colombia durante el periodo 1890-1936, tiempo de vigencia del Código Penal de 1890, en lo que concierne a la naturalización del delito, los dispositivos discursivos, las ocurrencias, el uso de la violencia y la interpretación normativa; abordando aspectos jurídicos en su controversia frente a la inimputabilidad y atenuación de la pena. Igualmente, se estudian los saberes decimonónicos involucrados en la penalización, como son las ciencias criminales, la medicina legal y se analizan las valoraciones morales que se entrelazaron alrededor de las historias de los sujetos protagonistas. Es decir, el trabajo al tener en cuenta los saberes conexos al crimen, en relación a la yuxtaposición entre el aparato judicial, la criminología positivista y la medicina pericial, logra abordar temas vinculados a la ausencia de responsabilidad como los desencadenantes de la celotipia, entre otros, que permiten explicar la presencia o carencia de la premeditación, la alevosía o la culpa; que son examinados en una época de influencia de la cultura patriarcal, que por las derivaciones valorativas de la moral podían llegar a excusar al crimen pasional.
Abstract. This doctoral research investigates the historical construction of the concept crime of passion in a study about Colombia during the period 1890-1936, which corresponds to 1890's validity Penal Code, concerning the naturalization of crime, discursive devices, occurrences, use of violence and normative interpretation, approaching legal issues such as the not being subject to prosecution due to insanity defense and mitigation of punishment. Similarly, nineteenth-century's knowledges involved in the criminalization is studied, such as criminal science, forensic medicine or moral ratings that are interlace around the stories of the protagonist people. That is, this research takes into account the knowledge related to the crime, in relation to juxtaposition between the judiciary power, the positivist criminology, and expert medicine, to find issues related to the absence of responsibility as triggers of jealousy, among others, that explain the presence or lack of premeditation, treachery or guilt; which are examined at an era of patriarchal culture's influence, which leads to valuations about of morality that could be excuses of passion's crime.
