Restituir o liberar: la lucha por el territorio y la madre tierra

Abstract

El tratamiento histórico y el manejo actual que se le ha dado al derecho al territorio en cabeza de los grupos étnicos del país han llevado a que la lucha por sus derechos traspase ámbitos jurídico-institucionales, generando nuevos espacios de lucha y resistencia. De un total de 2.517 sentencias que han sido falladas en virtud de la Ley 1448 de 2011, en materia étnica se encuentra que, bajo los decreto-ley 4633 y 4635, sólo han sido falladas 6 sentencias (hasta el primer semestre de 2017) de un total de 28 demandas presentadas, correspondiendo a 5 sentencias sobre restitución indígena y 1 sobre restitución de comunidades negras. Mientras esto pasa en el ámbito judicial, el Pueblo Nasa del Norte del Cauca resiste al despojo y desplazamiento al que han sido sometidos mediante la liberación de la madre tierra, proceso político de toma de haciendas, pero también ecológico al abogar por la defensa de la tierra ante los abusos de químicos y monocultivos.

Abstract: The historical treatment and the current management that has been given to the right to territory in charge of the ethnic groups of the country have led to the fight for their rights transcending juridical - institutional areas, generating new spaces of struggle and resistance. Of a total of 2,517 judgments that have been ruled under Law 1448 of 2011, in ethnic matters it is found that, under decree - laws 4633 and 4635, only 6 sentences (until the first semester of 2017) have b een handed down of a total of 28 lawsuits filed, correspondin g to 5 sentences on indigenous restitution and 1 on restitution of black communities. While this is happening in the judicial field, the indigenous people of the North of Cauca resist the dispossession and displacement to which they have been subjected through the liberation of mother earth, a political process of taking land, but also an ecological process advocating for the defense of land against of chemical and monoculture abuses.
