Resumen
El presente trabajo aborda la filiación desde el punto de vista de las acciones de impugnación de paternidad promovidas por herederos, las incidencias que este tipo de asuntos tiene a nivel personal, del estado civil y, en especial, de la posibilidad que, en caso de evidenciarse daños, estos puedan ser resarcidos.
El punto de inicio con el que se decidió estudiar el tema es que, en Colombia, la filiación es un derecho fundamental; además que, por ese carácter, el análisis con que ha sido abordado por la jurisprudencia es que debe protegerse el derecho a conocer la verdad sobre la filiación biológica, esto es, a tener conocimiento quién es padre biológico, esa fue la justificación para que la normatividad contemplara las acciones de filiación (investigación e impugnación). La noción de la filiación biológica en la normatividad se extendió hasta incluso contemplar la protección de esa verdad con posterioridad a la muerte del padre, en ese sentido, una persona puede tener definida su filiación y estado civil durante toda su vida, sin embargo, el Código Civil, en concreto, en sus artículos 219 y 222, contemplan que ese vínculo puede controvertirse con posterioridad al fallecimiento del padre, es decir, los herederos pueden cuestionar esa filiación que se presume consolidada.
Esa postura contenida en el Código Civil es problemática para el hijo no biológico, cuyo padre, con ese conocimiento, por voluntad, mantuvo el estado civil haciéndolo parte de la familia, pues implica la pérdida de ese vínculo adquirido. Para esos casos, la legislación ni la jurisprudencia contemplan mecanismos de reparación. No obstante, ha existido reconocimiento de este tipo de familias o de filiación, aunque no puede dejarse de lado que, la tendencia en la legislación es la protección es a través de la caducidad de la acción de filiación o, por el reconocimiento expreso efectuado por el padre no biológico en instrumento público, más no desde los lazos familiares creados (paternidad socio afectiva).
La inquietud que entonces motivó este trabajo es sobre la justicia material para aquellas personas que pierden o perdieron su filiación y estado civil, consolidado en vida del padre no biológico, por aquiescencia de este, pese a no existir nexo genético, y que por las acciones de estado ejercidas por los herederos dejan de ostentarlo. Abstract
This paper addresses the subjet of filiation from the perspective of the paternity disputes
initiated by the heirs of the father, also the implications of that kind of matters have on a
personal level, the civil status, and, especially, the posibility of compensating damages
caused by the loss of the filiation.
It was decided to study the subject by having in mind that in Colombia filiation is a
constitutional right. Also, by recognizing that because of the aforementioned nature,
jurisprudence has analized filiation by being emphatic in protecting the rigth that people
have to acquire the knowledge of their biological parentage, this is, acquiring the knowledge
of who their biological father is, and that is the main reason why legislation contains legal
filiation proceedings such as investigation and disputes. The notion of protecting the right
to know about a person’s biological sonship, has extended to the point that knowing the
origin can be contested even after the father’s death; in that way, a person throughout their
life can have a defined filiation and civil status, however, in accordance with the Civil Code
(items 219 and 222), the heirs of the father can challenge that presumed established
filiation.
The Civil Code contains a problematic aproach for the non biological offspring, whose
father, with the knowledge of not being the parent, kept the civil status of the child, thus
making it part of the family; therefore, the effect that the dispute of filiation has, is the lose
of the status acquired within the family. In those cases, neither the legislation nor the
jurisprudence have contemplated the posibility of a claimed for damages. Nevertheless,
there has been a tendency to acknowledge this type of families, the ones whose members do not have a biological relation with one another, and the legislation contemplates
proceedings oriented to protect the acquired filiation, such as statute of limitations to start
the dispute or the aknowledgement of paternity made by the father in a notarial deed or a
public instrument, but not so much from the affective relationship created or the concept of
socio affective paternity.
In that context, the matter of question that motivated this paper is if there should be a form
of justice or compensation for those people that could lose their paternal filiation or that
have lost it in spite of the conscious decision of the non biological father to maintain the
relation.
