El presente trabajo tiene como objetivo analizar las tensiones en torno al concepto de Constitución que atraviesan los debates de la Corte Suprema de Justicia entre 1968 y 1991, tanto en las sentencias de control constitucional de los decretos dictados al amparo del estado de sitio previsto en el artículo 121 de la Constitución de 1886, como en las acciones públicas de inconstitucionalidad interpuestas contra actos reformatorios de la Constitución. Para analizar dichas tensiones, se adopta como marco teórico y metodológico la historia conceptual, con el fin de identificar la realidad discursiva y las transformaciones políticas y sociales que subyacen a las decisiones de la Corte Suprema de Justicia. El análisis permite mostrar que, en el trasfondo de las deliberaciones de sus magistrados, persistió una confrontación entre el positivismo kelseniano y una concepción material y política de la Constitución, de raíz schmittiana, cuyo desarrollo terminó por allanar el camino hacia la Asamblea Constitucional de 1991. Abstract
This masters dissertations examines the tensions surrounding the concept of the Constitution that permeated the debates of the Corte Suprema de Justicia between 1968 and 1991, both in its constitutional review of decrees issued under the state of siege established in Article 121 of the 1886 Constitution, and in the public actions of unconstitutionality brought against acts that reform the Constitution. To analyze these tensions, the study adopts conceptual history as its theoretical and methodological framework, with the aim of identifying the discursive reality and the political and social transformations underlying the Court’s decisions. The analysis shows that, beneath the deliberations of the Court’s justices, there persisted a confrontation between Kelsenian positivism and a material and political conception of the Constitution rooted in Schmittian thought, whose development ultimately paved the way for the Constitutional Assembly of 1991.
