Resumen
En Colombia, la contratación estatal es el mecanismo a través del cual las entidades del Estado adquieren obras, bienes y servicios para los ciudadanos, satisfacen sus necesidades, materializan los fines del Estado, y garantizan el interés general y el bien común. Sin embargo, como producto de los diferentes fenómenos internacionales ‒como los acuerdos estructurantes‒, la globalización, las aperturas económicas y la idea de eficiencia y el beneficio de unos pocos han influenciado sus lógicas, al presentar el mercado como actor principal, por cuanto su control representa a quien establece las reglas.
Luego de que el mundo evidenciara los peligros de llevar a ultranza las normas en el Estado de derecho (ED) sin una idea de moral o justicia, se reevaluaron las estructuras del positivismo, se implantó la teoría del neoconstitucionalismo, y se señaló que se necesitaba un Estado que garantizara las necesidades básicas de los asociados y que protegiera los postulados de la dignidad humana, la igualdad y la solidaridad. De allí nació la figura del Estado social de derecho (ESD).
Tal forma de Estado se adoptó en Colombia a través de la Constitución Política de Colombia (CP) de 1991; sin embargo, el estatuto de la contratación estatal, reglamentada en 1993 a través de la Ley 80, con una única reforma a través de la Ley 1150 de 2007, ha estado desconectado de los fines de dicho modelo estatal y ha sido más bien la respuesta a las “recomendaciones” internacionales de interés capitalista y neoliberal, donde lo importante es el mercado. En este punto, la economía se estructura bajo la prestación de bienes y servicios y busca el control del mercado, toda vez que puede generar la incidencia en las esferas políticas, económicas y de reglamentación.
Esta visión de la contratación ha llevado a reducirla a una “compra pública”, donde lo importante es la oferta y la demanda, y donde se pretende buscar el mayor valor, expresado en dinero, para garantizar la eficiencia administrativa y la transparencia. Entonces, la compra pública se convirtió en el centro de la agenda del progreso económico y se presenta como un asunto de gerencia pública, estratégica para el funcionamiento del Estado, y como una herramienta para controlar el mercado a través del precio y la competencia.
En virtud de la visión mercantilista, y con el fin de imponer el mercado como artífice, se abrió el camino para la creación de la Agencia Nacional de Contratación Pública Colombia Compra Eficiente (ANCPCCE). Esto, para que dicha agencia fuera un ente rector y/o regulador del mercado de compras públicas (MCP) y creara políticas unificadas que sirvieran de guía a los administradores de compras para hacerle seguimiento y evaluación al desempeño del sistema, y para concentrar la oferta de los bienes y servicios bajo la luz de la libertad de empresa, la libre competencia y el neocapitalismo.
En este negocio o modelo económico contractual, participan entidades públicas y privadas; estas últimas con sus propios intereses y agendas, que siempre están por encima del interés general, por lo que en dicha relación mercantilista el ciudadano del común es ignorado. De ese modo, se ha invisibilizado al beneficiario último, entendiendo por este el ciudadano de a pie que espera que los bienes, obras y servicios lleguen de la mejor manera y satisfagan su necesidad; sin embargo, este no forma parte de ninguno de los extremos del contrato estatal, aunque materializa el concepto de bien común y el cumplimiento de los fines del Estado, por lo que no podría estar en el marco de una teoría neoliberalista.
De esa manera, al reducir las compras públicas al precio, los bienes y servicios se convierten en simples mercancías, así como los contratistas en proveedores; y, aun cuando el beneficiario final es quien debe esperar los resultados del proceso administrativo para la escogencia del contratista del que no participa ni conoce, es a quien se encargan las demoras, los incumplimientos, la baja calidad de los bienes o productos, y la ausencia de servicios. En suma, a este sujeto solo se le recuerda para las estadísticas finales o para reportar el cumplimiento o el pago a los proveedores.
Por ello, es necesario un cambio en el modelo de la contratación de obras, bienes y servicios, donde se ha privilegiado la posición de la empresa, del lucro y de las fuerzas económicas. En otras palabras, es esencial volver a los derechos del sujeto, al interés general, al bien común, a fin de reestructurar la política de compra y contratación estatal y entregar sus elementos estructurantes. Se debe poner al sujeto y sus derechos como la piedra angular del proceso de la contratación, se debe interiorizar que la contratación no es sinónimo de corrupción, y se debe imponer el poder sancionador.
Finalmente, el modelo propuesto para modificar la visión de la contratación estatal en el ordenamiento colombiano se encuentra en cinco presupuestos: el primero se adhiere a la constitucionalización del derecho administrativo y al correspondiente ajuste normativo del estatuto de la contratación estatal. El segundo se refiere a la obligatoriedad de respetar los acuerdos internacionales en el derecho interno. El tercero establece la necesidad de rediseñar, reformular y replantear la política pública de compra y contratación estatal y realizar un cambio normativo que reforme el Estatuto contractual y ponga énfasis en los derechos de los sujetos y no el mercado. El cuarto apunta al seguimiento y la evaluación de la política de compra y contratación estatal a través de los correspondientes indicadores. Por último, el quinto propone garantizar la protección de los derechos de los ciudadanos, por lo que es necesario realizar lo pertinente en las sedes administrativa y jurisdiccional.
Este modelo buscar reemplazar el precio por el sujeto, el interés particular por el general, el mayor valor en dinero por el mayor valor público, el atajo por el procedimiento, la competencia por la equidad, la utilidad por la justicia, y las relaciones de consumo por derechos. Abstract
In Colombia, state contracting is the mechanism through which state entities acquire works, goods and services for citizens, satisfy their needs, materialize the state's goals, and guarantee the general interest and the common good. However, because of different international phenomena ‒such as structuring agreements, globalization, economic openings and the idea of justice for the benefit of a few have influenced its logic, presenting the market as the main actor, since its control represents whoever establishes the rules.
After the world became aware of the dangers of taking the rule of law to the extreme without an idea of morality or justice, the structures of positivism were re-evaluated, the theory of neo-constitutionalism was implemented, and it was pointed out that a state that would guarantee the basic needs of the associates and protect the postulates of human dignity, equality and solidarity was needed. From there, the figure of the social rule of law was born.
Such a form of state was adopted in Colombia through the Political Constitution of Colombia of 1991; however, the State Contracting Statute, regulated in 1993 through Law 80, with a single reform through Law 1150 of 2007, has been disconnected from the purposes of said state model, and has been rather the response to the international “recommendations” of capitalist and neoliberal interest, where the important thing is the market. At this point, the economy is structured under the provision of goods and services, and it seeks control of the market, since it can generate an impact in the political, economic and regulatory spheres.
This vision of contracting has led to reducing it to a “public purchase,” where the important thing is supply and demand, and where the aim is to seek the highest value, expressed in money, to guarantee administrative efficiency and transparency. Thus, public procurement became the center of the economic progress agenda and is presented as a matter of public management, strategic for the functioning of the state, and as a tool to control the market through price and competition.
Under the mercantilist vision, and to impose the market as the architect, the way was paved for the creation of the National Agency for Public Procurement Colombia Efficient Purchase. This, so that said agency would be the regulatory entity of the public procurement market, and would create unified policies that would serve as a guide to purchasing managers to monitor and evaluate the performance of the system, and to concentrate the supply of goods and services under the light of freedom of enterprise, free competition and neo-capitalism.
In this business or contractual economic model, public and private entities participate; the latter with their own interests and agendas, which are always above the general interest, so that in said mercantilist relationship there is no place for the common citizen. This way, the ultimate beneficiary, who is the average citizen who expects goods, works and services to arrive in the best way and satisfy their need, has been rendered invisible; however, this person is not part of any of the extremes of the state contract, although they materialize the concept of the common good and the fulfillment of the state's purposes, so they could not be within the framework of a neoliberal theory.
That way, by reducing public purchases to price, goods and services become simple merchandise, as well as contractors become suppliers; and, even though the final beneficiary is the one who must wait for the results of the administrative process for the selection of the contractor in which they do not participate or know, they are responsible for the delays, non-compliance, low quality of goods or products, and the absence of services. In short, this subject is only remembered for the final statistics or to report compliance or payment to suppliers.
Therefore, a change is needed in the model of contracting works, goods and services, where the position of the company, profit and economic forces have been privileged. In other words, it is essential to return to the rights of the subject, to the general interest, to the common good, to restructure the state purchasing and contracting policy and deliver its structuring elements. The subject and their rights must be placed as the cornerstone of the contracting process, and it must be internalized that contracting is not synonymous with corruption, and the power to sanction must be imposed.
Finally, the proposed model to modify the vision of state contracting in the Colombian legal system is based on five assumptions: the first adheres to the constitutionalization of administrative law and the corresponding regulatory adjustment of the statute of state contracting. The second refers to the obligation regarding international agreements in domestic law. The third establishes the need to redesign, reformulate and rethink public policy regarding state purchasing and contracting, and to implement a regulatory change that reforms the contracting statute and places emphasis on the rights of the parties involved rather than on the market. The fourth aims at monitoring and evaluating the state purchasing and contracting policy through the corresponding indicators. The fifth proposes guaranteeing the protection of citizens' rights, so it is necessary to do what is pertinent in the administrative and jurisdictional headquarters.
This model seeks to replace the price with the subject, the particular interest with the collective, the highest monetary value with the highest public value, the shortcut with the procedure, competition with equity, utility with justice, and consumer relations with rights. In short, it is a public contracting from and for society.
