Abstract
The purpose of this thesis is to study the right to reparation for victims of armed
conflict and the notion of transformative reparation embedded in reparations programs, with the
objective of advancing a practical definition of transformative reparation. To this end, the right to
reparation for victims is initially addressed, as well as the existing discussions about its scope,
especially considering reparation programs as a transitional justice mechanism. Additionally, social
transformation and its relation to transitional justice is studied. Subsequently, the thesis analyzes the
definition of transformative reparation itself, a definition is proposed, emphasizing on the
possibilities of implementing it through a reparations program. Finally, the last chapter studies the
case of Colombia’s Administrative Reparation Program, which adopts the notion of transformative
reparation in its legal framework. The Colombian case is evaluated based on the elements and
criteria proposed in the practical definition of transformative reparation, and the findings of the field
work’s carried out in two communities that are victims of the armed conflict in Colombia: Riachuelo
and Liberia. Some practical lessons are extracted to try to solve the dilemmas of reparation to the
victims of the armed conflict.
