Resumen
El trabajo de investigación da cuenta del insumo teórico del positivismo criminológico, y las narrativas sobre el derecho penal del enemigo, y las nuevas prácticas seguritarias que enfrenta la fuerza reduccionista del estado de garantías.
En este contexto la política criminal encausada por el Estado colombiano al promulgar la Ley 2197 de seguridad ciudadana refuerza elementos normativos del biologicismo peligrosista, incluso al punto de instrumentalizar las narrativas de lucha y emancipación del activismo social, que paradójicamente han sido elementos normativos por el cual el paradigma del estado de garantías se nutre para desplegar y reducir al límite el poder punitivo del Estado.
Finalmente, la lucha identitaria y contestataria debe reinventarse para orientar políticas criminales no expansionistas, las cuales han encontrado en los discursos de seguridad ciudadana la narrativa romántica para encubrir su fuerza letal sobre los individuos débiles de la sociedad. Abstract
The research wok accounts for the theoretical input of criminological positivism, and the narratives about the criminal law of the enemy, and the new security practices that confront the reductionist force of the state of guarantees.
In this context, the criminal policy pursed by the colombian State when enacting Law 2197 on citizen security reinforces normative elemnts of dangerous biologicalism, even to the point of instrumentalizing the narratives of strggle and emancipation of social activism , which paradoxically have been normative elments by which. The paradigm of the State of guarantees is nourished to deploy and reduce to the limit the punitive power of the State.
Fnally, the identity and protest struggle must be reivented to guide non-expansionist criminal policies, which have found in citizen security discourses the romantic narrative to conceal their lethal force on the weak individuals of society.
