dc.description.abstractCon el propósito de identificar los eventos en los que se debe aplicar la regulación del Derecho del Trabajo, La Organización Internacional del Trabajo ha establecido a la Relación Laboral como la institución definitoria para delimitar el espectro de aplicación de los Estándares Internacionales del Trabajo en las interacciones económicas entre el capital y el trabajo. Los modelos de contratación de mano de obra surgidos en las economías colaborativas se constituyen como un caso paradigmático que evidencia los problemas de aplicación de los Estándares Internacionales del Trabajo en los Estados Nacionales que basan el concepto de Relación Laboral en el criterio de subordinación. Con el propósito de solucionar este problema de implementación, en el año 2006 la Conferencia Internacional del Trabajo expidió la recomendación 198, que define diversos indicios para establecer la existencia de una Relación Laboral. Al carecer este instrumento de un carácter vinculante, el principio de Dependencia Económica ha sido utilizado para establecer relaciones laborales no subordinadas. Teniendo presente lo anterior, el presente documento pretende estudiar si el principio de Dependencia Económica puede constituirse como un Principio General del Derecho Internacional del Trabajo. Para ello, se aplicará el test elaborado por Comisión de Derecho Internacional de las Naciones Unidas sobre la materia, lo que conllevará el estudio de la Dependencia Económica en las principales familias jurídicas. dc.description.abstractIn order to identify the events in which the regulation of Labor Law must be applied, the International Labor Organization has established the Employment Relationship as the defining institution to delimit the spectrum of application of International Labor Standards in the economic interactions between capital and labor. The labor contracting models that have emerged in the collaborative economies constitute a paradigmatic case that evidences the problems of application of the International Labor Standards in the Nation States that base the concept of Labor Relationship on the criterion of subordination. In order to solve this implementation problem, in 2006 the International Labor Conference issued Recommendation 198, which defines various indicators to establish the existence of an Employment Relationship. Since this instrument is not binding, the principle of Economic Dependence has been used to establish non-subordinate labor relationships. With this in mind, the present paper aims to study whether the principle of Economic Dependency can be constituted as a General Principle of International Labor Law. For this purpose, the test elaborated by the International Law Commission of the United Nations on the subject will be applied, which will entail the study of Economic Dependency in the main legal families.eng
