Abstract
The peasant population living and making use of areas of National Natural
Parks, after the historical processes of expansion of the agricultural frontier, faces a limited
realization of rights, given the restrictions contemplated by the legal framework in
environmental matters. The above evidences a tension of constitutional rights between
those of the peasant communities (subjects of special constitutional protection) and the
collective right to a healthy environment that is intended to materialize, among other
instruments, with the national natural parks. After a historical and legal analysis, this
document seeks a solution that allows, to the greatest extent possible, the weighing and
realization materialization of the pesant's rights in tension.
